2. Customer Responsibilities
Although we strive to store our customers' data as securely as possible, there is always a minimal risk of data loss regardless of all security measures. Therefore, as a customer, you are responsible for making an additional backup of all images, videos and other data you choose to submit or store with us.
We cannot be held responsible or liable for events beyond our control or in the event of Force Majeure – nor for data loss in connection with storage or backup in the services we provide.
3. Order
When you have completed your order online, an order confirmation will be sent to your email address. In the confirmation you will find all information about products, price, billing and delivery address. When ordering in store, you will receive an order receipt that you must present when picking up your completed order.
If there is an error in the order confirmation when ordering online, you should immediately contact us with your order number via email to info@photofun.se or info@videokopiering.se
We apply advance payment via Swish, card or advance invoice (49:- invoicing fee added).
We assume that you as a customer have permission to let us copy any material you provide us with for digitization or copying, and that you respect copyright laws and regulations. Where possible, we also assume that you have made backups of the digital files you let us handle.
4. Delivery & shipping
We deliver our products in-store or via postal delivery, from 69 kr. However, delivery may be delayed or not possible in cases where manual fraud checks are required for specific orders.
If delays in postal delivery should occur (without us having notified you of a longer delivery time), please contact us at the email address:info@photofun.se. We reserve the right for delays and events beyond our control.
The right of withdrawal does not apply to specially ordered products, which means that once we have started production, you cannot cancel your order. In the event of any damage to or loss of films, compensation will be provided in the form of unexposed film. In the event of damage to or loss of digital media, no compensation will be provided. No further liability or compensation can be claimed.
All orders are treated with care. We take no responsibility for orders not picked up within 3 months.
For digital delivery, you as the customer are responsible for promptly downloading your files for safe backup. We recommend that you save them in at least two places for extra security. If you use our cloud storage service, it is also important that you save the files in at least one other place. In the event of non-payment of the service, your files may be deleted after six months.
For uncollected packages, we charge return shipping from 199 kr and upwards (higher fee for larger packages).
5. Prices
All prices in store are listed in Swedish kronor (SEK) and all prices include 25% VAT.
We reserve the right to price changes caused by price changes from suppliers, errors in the price list and errors in prices due to incorrect information and reserve the right to adjust the price in accordance with applicable laws and regulations.
Some products, such as narrow film transfers, have prices that cannot be calculated in advance. We will then take an advance payment as an estimate, and you will then have to pay any difference before you receive the finished delivery.
6. Withdrawal
The normal 14-day right of withdrawal for distance selling for private individuals does not apply to our image and transfer products because it concerns goods that have been specially ordered and manufactured according to the consumer's instructions or that have otherwise been given a clear personal touch, according to 2005:59 Chapter 2 § 11:3. 7. Complaints/loss
In the event of damage or error to a delivered digital product, we reserve the right to first check and attempt to remedy the error before the purchase can be cancelled and a refund is made. In the event of any loss or damage to a customer order, our customers are primarily compensated with a new equivalent product or replacement according to industry standards.
8. Limitation of liability
We take no responsibility for indirect damages that may arise due to the product.
We accept no liability for delays/errors due to circumstances beyond the company's control (Force Majeure). These circumstances may include, for example, labor disputes, fire, war, government decisions, reduced or non-existent delivery from the supplier.
Furthermore, no responsibility is taken for any changes to products/product characteristics that have been changed by the respective supplier and other factors beyond our control.
9. Product information
We reserve the right to make any errors on this website and to finalize the sale of products. We do not guarantee that the images reflect the exact appearance of the products as some color difference may occur depending on the monitor, photo quality and resolution. We always try our best to expose the products as accurately as possible.
10. Changes to Terms and Conditions
We reserve the right to make changes to our Terms and Conditions of Sale at any time. Changes to the Terms and Conditions will be posted online on the Website. The changed Terms and Conditions are deemed accepted when you place an order or visit the Website.
11. Dispute and choice of law
In the event that a dispute cannot be resolved by mutual agreement between the company's customer service and the customer, you as a customer can contact the Swedish General Complaints Board, see arn.se. For residents of an EU country other than Sweden, you can submit a complaint online via the EU Commission's platform for dispute resolution, see http://ec.europa.eu/consumers/odr.
In the event of a dispute, we will follow decisions from ARN or a corresponding dispute resolution body.
Any dispute regarding the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish law. Any dispute between the customer and the above-mentioned companies shall in the first instance be resolved amicably on site in Sweden or by telephone/Teams or similar service. If this is unsuccessful, either party may bring an action in a general Swedish court. Any legal dispute on site shall always be held in Stockholm, Sweden.
12. Other
Any additions to these terms and conditions may occur in connection with registration, login, submission of customer material or ordering a product or service. In such cases, you as the customer will be informed of this.
We disclaim any force majeure and reserve the right to make any typos/pricing errors on our website.
